Article 11. Compatibility of unemployment benefits with part-time work in certain cases.

As of the entry into force of this royal decree-law, when the unemployment benefits recognized in the scope of the temporary employment regulation files referred to in articles 1, 2 and 3 and the first additional provision of this royal decree-law are compatible with the performance of a part-time job not affected by suspension measures, the portion proportional to the time worked will not be deducted from the amount of the benefit.

Article 12. Economic compensation in certain cases of compatibility of the contributory unemployment benefit with part-time work.

1. The beneficiaries of the unemployment benefit regulated in article 25.1 of Royal Decree-Law 8/2020, of March 17, of extraordinary urgent measures to face the economic and social impact of COVID-19, the amount of which has been seen reduced in proportion to the time worked, in application of article 282.1 of the consolidated text of the General Law of Social Security, for maintaining at the time of initial recognition one or more part-time labor relations not affected by temporary employment regulation procedures , will have the right to receive an economic compensation whose amount will be equivalent to what was left to receive for the deduction made.

2. Said compensation shall be paid in a single payment upon request of the interested party, formalized in the model established for this purpose. The request will necessarily be submitted through the SEPE electronic headquarters, within the period from the entry into force of this royal decree-law and until June 30, 2021. The presentation of the request outside this period will imply your refusal.

3. The maximum period for the State Public Employment Service to resolve the submitted applications will be extended until July 31, 2021. After said period has elapsed without an express resolution, the applicant may understand that their application has been rejected.
