Extraordinary benefit for people with a fixed discontinuous contract or who carry out fixed and periodic jobs that are repeated on certain dates

Article 9. Extraordinary benefit for people with a fixed discontinuous contract or who carry out fixed and periodic jobs that are repeated on certain dates.

1. The extraordinary benefit will be recognized to workers with a fixed discontinuous contract and to those who perform fixed and periodic jobs that are repeated on certain dates that have been affected, during all or part of the last theoretical period of activity, by a regulatory file temporary employment based on the causes contained in articles 22 and 23 of Royal Decree 8/2020, of March 17, when they are no longer affected by the temporary employment regulation file because the date on which the period of employment has ended exercise.

2. Likewise, the extraordinary benefit will be recognized to workers with a fixed discontinuous contract and to those who perform fixed and periodic jobs that are repeated on certain dates that, due to having found themselves in any of the cases provided for in letters b) to d) of article 25.6 of Royal Decree-Law 8/2020, of March 17, have been beneficiaries of any of these measures, provided that, once exhausted, they continue to be unemployed and without the right to receive unemployment benefits at a contributory or welfare level, or exhaust them before January 31, 2021.

3. The recognition of this benefit, for the people included in section 1, will require the presentation by the company of a collective request for extraordinary benefits, which will include all the people with a fixed discontinuous contract or to carry out fixed jobs and newspapers that are repeated on certain dates that are no longer affected by the temporary employment regulation file.

In the case of cases in section 2, it will be the affected workers themselves who must request the extraordinary benefit regulated in this article.

4. For situations that occur before the date of entry into force of this rule, the term will be 15 days from the entry into force of this royal decree-law.

5. The duration of this extraordinary benefit will run from the end of the measure provided for in article 25.6 of Royal Decree-Law 8/2020, of March 17, of which the beneficiary has been, until January 31, 2021 .

6. This benefit will be paid for monthly periods and in the same amount as the last contributory unemployment benefit that the affected person had received or, where appropriate, the minimum amount of the contributory benefit.
