DECREE 44/2020, of April 3, of the council, of approval of the regulatory bases for the direct granting of urgent aid to self-employed workers affected by Covid-19.

Article 1. Purpose and scope

The purpose of this decree is to approve the bases that regulate the granting of aid to autonomous workers in the Valencian Community, including members of associated work cooperatives.

Article 3. Beneficiaries and requirements

1. People who meet the following requirements may be beneficiaries:

a) Have been continuously registered in the Special Regime for Self-Employed Workers during, at least, the period between December 31, 2019 and March 14, 2020.

b) Have suspended the activity as a result of the measures adopted by Royal Decree 463/2020, of March 14 or, in case of maintaining the activity, have reduced the corresponding invoicing for the month prior to the request for aid in, at less, 75 percent with respect to the average invoiced in the natural semester prior to the declaration of the state of alarm. The assessment will be carried out taking into account the period of activity.

c) Have the fiscal domicile in the Valencian Community.

2. Self-employed persons who:

a) On March 14, 2020 or later, they were employed workers.

b) They obtained net returns from their economic activity of more than 30,000 euros in 2019.

Article 4. Amount of aid

1. The amount of aid will amount to 1,500 euros for people forced to suspend activities by Royal Decree 463/2020 and 750 euros for the rest.

Fund approved for the province of Alicante: 21,500,000 euros

Article 5. Form and deadline for submitting applications

1. The application will be submitted electronically at the electronic headquarters of the Generalitat Valenciana, through the procedure enabled for this purpose called "EAUCOV 2020 Extraordinary aid to self-employed workers Covid-19". On the LABORA website (http://www.labora.gva.es/ciutadania/busque-ajudes-subvencions/ajudesfoment-del-ocupacio) The information and documentation of the call will be available and access to the electronic office will be enabled to make the request. Any request submitted following a procedure other than that described here will be inadmissible.

2. If you do not have an advanced electronic signature, you must go to the representation through a person who does, accrediting the representation.

3. The application period will start on April 8, 2020 and will end at 09:00 on May 4, 2020.

Article 6. Documentation that must accompany the request

1. Along with the request, the following documentation will be provided:

a) Certificate of status in the census of economic activities of the State Agency for Tax Administration.

b) Responsible statement regarding the requirements.

c) Direct debit model

d) In case of not having an electronic signature, a representation form will be provided.

e) Responsible declaration of the de minimis aid granted to the applicant during the two previous fiscal years and during the current fiscal year, as well as other state aid for the same risk financing measures, in order to verify that they are not exceed the limits of Article 5 (2) of Regulation (EU) no. 1407/2013, of the Commission, of December 18, 2013, according to the standard model.

2. Only one application per person will be accepted.

3. Unless there is express opposition by the applicant, in which case they must provide the corresponding supporting documentation, the presentation of the application implies authorization to LABORA Valencian Employment and Training Service (hereinafter LABORA) to be obtained through the Autonomous Intermediation Platform (PAI) and other systems enabled for the purpose of the information related to the following:

a) Identity of the applicant natural person.

b) Work Life

c) Positive certification from the State Agency for Tax Administration and the General Treasury of Social Security, if they are up-to-date in compliance with tax obligations and with Social Security.

d) Certification of the State Tax Administration Agency regarding the income from economic activity, tax domicile and any of the requirements demanded of the beneficiary persons.

Article 7. Instruction

The term to resolve and notify the appropriate resolution will be 3 months from the entry of the request in the electronic headquarters of the Generalitat.

Article 9. Payment method

The liquidation and payment of the aid will be carried out once the fulfillment of the requirements is justified with the documentation presented together with the application. The amount of the aid will be released at one time after the award decision is issued.

Article 10. Obligations

Maintain autonomous activity for at least 3 months, counting from the day the suspension of the activity becomes ineffective.

Article 12. Incompatibilities

With the exception of the Social Security quota bonus and the state extraordinary benefit for self-employed workers affected by the crisis caused by Covid-19, these subsidies are incompatible with other subsidies, aids, income or resources for the same purpose, coming from any administration or entity, public or private, national, of the European Union or of international organizations.
