ORDER OF NOVEMBER 10, 2021, OF THE MINISTRY OF THE PRESIDENCY, TOURISM AND SPORTS BY WHICH THE REGULATORY BASES OF AID TO TOURISM GUIDES AND SMES, MICRO-SMES AND AUTONOMOUS TRAVEL ACTIVITY ACTIVITY ARE APPROVED WITH EXTRAORDINARY CHARACTER , ORGANIZATION OF CONGRESSES OR HOSPITALITY TO COMPARE LOSSES IN WHICH THEY HAVE INCURRED AS A CONSEQUENCE OF COVID-19, OF THE TOURISM AND HOSPITALITY REACTIVE STRATEGY, AND WHOSE AID REQUESTS WERE DIS-ESTIMATED DUE TO EXHAUSTING THE CREDIT.

Article 1.- Purpose.

The purpose of this provision is to establish the regulatory bases of subsidies, on an extraordinary basis, aimed at tourist guides and SMEs, micro-SMEs and freelancers in the Region of Murcia with active tourism activity, travel agency, organization of congresses or hospitality. (bars, cafes, restaurants, nightlife, discos, catering companies and function rooms) to alleviate the loss of income they have suffered as a result of the COVID-19 health crisis during the duration of the mandatory periods of total suspension or reduction of their activity.

Article 2.- Purpose.

The purpose of the subsidy is, on an exceptional and extraordinary basis, to contribute to the survival and encourage the maintenance in their activity of tourist guides and SMEs, micro-SMEs and freelancers of the Region of Murcia with active tourism activity, travel agency, organization of conferences or hospitality (bars, cafes, restaurants, nightlife, discos, catering companies and function rooms), while the economy recovers.

Article 3.- Procedure.

The subsidies will be awarded in accordance with the concession regime provided for in article 22 of Law 7/2005, of November 18, on Subsidies from the Autonomous Community of the Region of Murcia, up to the budget credit limit established in the call.

Consequently, the granting of the subsidies will be carried out according to the order of entry of the applications, and in the event that these were incomplete, from the date of completion of the file, provided that the beneficiaries meet the general and specific requirements established in the present Order.

Article 4.- Beneficiaries.

SMEs, micro-SMEs or freelancers with the activity of tourist guide, active tourism, travel agency, organization of congresses or hospitality (bars, cafes, restaurants, nightlife, discotheques, catering companies will be eligible for the aid provided for in these Bases). and celebration rooms), whose requests for aid were rejected by Resolution of the Director General of the Murcia Region Tourism Institute, dated February 12, 2021, due to exhaustion of the budget credit established in the call, and that appear in the Annex of said Resolution, as well as those whose appeals filed against the resolutions rejecting the request for assistance were rejected due to exhaustion of the credit established in the call.

Article 5.- Obligations of the beneficiaries.

2. The beneficiaries of the aid will be obliged to submit to the control of the Tourism Institute of the Region of Murcia, the General Audit of the Autonomous Community of the Region of Murcia, and other supervisory bodies.

Article 7.- Criteria for determining the amount of the subsidy.

1. Each natural or legal person may submit only one application, although they may receive a grant for each work center, with a maximum limit of 42,000 euros per beneficiary.

Article 8.- Compatibility of the subsidies.

2. These aids are complementary to those that the Government of Spain may approve, or any other aids called by the Autonomous Community of the Region of Murcia, for similar purposes.

Article 9.- Presentation of applications.

In accordance with the provisions of article 66.6 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations (LPAC), applications must be submitted through the specific form that will be available at https://sede.carm.es/ and only one application may be submitted for each applicant, considering those that are submitted in duplicate not submitted. The procedure number will be indicated in the corresponding call.

Article 10.- Deadline for submitting applications.

Subsidy applications must be submitted within the period provided for in the call, the extract of which will be published in the Official Gazette of the Region of Murcia.

Article 14.- Term of resolution.

1. The maximum term to resolve and notify the resolution of the procedure may not exceed six months from the date of submission of the application to the Institute of Tourism. This period may be exceptionally extended, in accordance with the provisions of article 23 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations.

Article 17.- Payment of the grants awarded.

1. The amount of the subsidy will be paid in a single payment, without requiring guarantees from the beneficiaries.

2. The payment of the aid will be made by transfer to the bank account indicated by the beneficiary in the application.

Final disposition. Entry into force.

This Order will enter into force on the same day of its complete publication in the Official Gazette of the Region of Murcia.
