Relaxation of restrictions to small municipalities and local entities

Order SND / 427/2020, of May 21, which relaxes certain restrictions derived from the health emergency caused by COVID-19 to small municipalities and local authorities of lower territorial scope

Article 1. Purpose.

The purpose of this order is to relax certain restrictions in the smaller municipalities that are still in Phase 0 and Phase 1 of the Transition Plan towards a new normality. In said municipalities, the regulations corresponding to the phase of the Plan in which the territorial unit is located shall apply, except in those aspects expressly regulated by this order.

Article 2. Scope of application.

1. This order will be applied to both the municipalities and the entities with a territorial scope that is less than the municipality set forth in article 24 bis of Law 7/1985, of April 2, Regulating the Bases of the Local Regime, when they have less of 10,001 inhabitants and population density of less than 100 inhabitants per square kilometer.

Article 3. Displacement of the child population and practice of non-professional physical activity.

1. The time bands established in Order SND / 370/2020, of April 25, on the conditions under which displacements by the child population should take place during the health crisis caused by COVID will not apply. -19, and Order SND / 380/2020, of April 30, on the conditions in which non-professional physical activity can be carried out outdoors during the crisis situation caused by COVID-19.

2. In the case of travel by minors under the age of 14, the limit of a responsible adult will not apply.

3. Said activity may be practiced in the municipal area or, failing that, within a maximum distance of five kilometers, including adjacent municipalities, provided that they are within the scope of this order and belong to the same territorial unit of reference. .

Article 4. Hygiene and prevention measures.

The opening of any of the establishments mentioned in this order will be subject to compliance with the general and specific hygiene and prevention measures included in Order SND / 414/2020, of May 16.

Article 5. Open air markets or non-sedentary sales.

When the Town Halls or governing bodies of the local entities of territorial territory inferior to the municipality so decide, the markets that develop their activity in the open air or non-sedentary sale on public roads, commonly called street markets, may proceed to reopening them, giving preference to those of food products and basic necessities, and ensuring that the products marketed in them guarantee their non-manipulation by consumers.

Article 6. Hotel and restaurant establishments.

1. The hotel and restaurant establishments for consumption on the premises may be reopened to the public, except for nightclub and nightlife bars, as established in Chapter IV of Order SND / 414/2020, of May 16.

2. The provision of the service in the outdoor terraces of the hotel and restaurant establishments will be carried out in accordance with the provisions of Order SND / 399/2020, of May 9.
