From January 1, 2020, the paternity leave will be extended to 12 weeks as established by Royal Decree-Law 6/2019 of urgent measures to guarantee equal treatment and opportunities between women and men in employment and occupation .
- The paternity leave will have a period of total suspension of 12 weeks, of which the first 4 will be enjoyed in a mandatory and uninterrupted manner immediately after the birth or judicial decision of adoption, kept for adoption or foster purposes.
- The remaining 8 weeks can be enjoyed, once the compulsory rest after delivery is finished, in an interrupted manner and for full weeks until the son or daughter turns one year old.
- This paternity leave is non-transferable, so if the father does not enjoy it, it cannot be transferred to the mother.
- Remind our clients, that by 2021 the same Royal Decree-Law 6/2019 will equate the duration of paternity leave to maternity leave, being a total of 16 weeks.
