Law 7/1985, of April 2, Regulating the Bases of Local Regime, modified by Law 27/2013, of December 27, on the rationalization and sustainability of the Local Administration, indicates in its Arts. 31 and 36, as the province's own purpose, to ensure the provision of the services of the municipal competence, attributing to the Diputación among its competences and to achieve such purpose the coordination of the municipal services among themselves.
On 05/08/2020, a written submission is sent to the General Directorate of Local Administration of the Valencian Generalitat, requesting a report on the absence of duplication or simultaneous execution of the same public service with another Public administration, pursuant to the provisions of article 7.4 of the Law. 7/1985, of April 2, Regulator of Bases of Local Regime, for the granting of subsidies to municipalities of the province of Alicante with the aim of minimizing the economic impact that COVID-19 is having on SMEs, micro-SMEs, self-employed and professionals from their municipalities.
Consequently, and taking into account that the reports in article 7.4 of the LRBRL are only necessary for the exercise of different powers from their own or attributed by delegation, the issuance of this is not appropriate, since it is a competence of the Provincial Council of Alicante according to the provisions of article 36.1b) of Law 7/1985. ” After carrying out the above calculations, the amounts of the subsidies to be awarded are adjusted proportionally to the total amount, which amounts to 6,000,000 euros.
