Grants to promote the permanent hiring of young people

ECOGJU 2021 - SUBSIDIES TO PROMOTE THE INDEFINITE HIRING OF QUALIFIED YOUNG PEOPLE (AVALEM JOVES) WITHIN THE FRAMEWORK OF THE NATIONAL YOUTH GUARANTEE SYSTEM

Purpose of the procedure

The purpose of this call is to award subsidies to promote the initial full-time indefinite hiring of qualified young people, who are registered as beneficiaries in the file of the National Youth Guarantee System, in the territorial area of the Valencian Community.

Who can start it?

Interested / Applicants

Any employer of a private legal nature, including self-employed persons, with a work center in the Valencian Community, may be a beneficiary of these aids.

Requirements

REQUIREMENTS OF THE BENEFICIARY ENTITIES:

Not being subject to the prohibitions to obtain the status of beneficiary indicated in sections 2 and 3 of article 13 of Law 38/2003, of November 17, General Subsidies.

EXCLUSIONS

· In no case may groups of natural or legal persons, public, public or private, civil companies, communities of property or any other type of economic unit or separate patrimony that, even lacking legal personality, could carry out the eligible actions.

· The assumptions contemplated in Resolution Seven of the Resolution calling for these grants are excluded from this program.

These aids are subject to the de minimis regime established in Regulation (EU) No. 1407/2013, of December 18, 2013, of the Commission, regarding the application of articles 107 and 108 of the Treaty on the Operation of the European Union to de minimis aid, published in the DOUE dated December 24, 2013. For this reason, they may NOT be granted to companies in the following sectors:

a) Fisheries and aquaculture, as contemplated in Council Regulation (EC) No. 104/2000.

b) Primary production of agricultural products (listed in Annex I to the Treaty).

c) The aid granted to companies that operate in the sector of transformation and marketing of agricultural products, in the following cases:

c.1) when the amount of the aid is determined based on the price or quantity of products of this type purchased from primary producers or marketed by interested companies.

c.2) when the aid is subject to part or all of it being passed on to primary producers.

d) Activities related to exports to third countries or Member States, that is to say, aid directly linked to the quantities exported, the establishment and operation of a distribution network or other current expenses linked to the export activity.

e) Aid conditional on the use of national products instead of imported ones.
On the other hand, the application of this scheme means that the total amount of de minimis aid granted to a single company will not exceed 200,000 euros during any period of three fiscal years. When a single company carries out road freight transport operations for someone else, the total amount of de minimis aid granted will not exceed 100,000 euros during any period of three fiscal years.

HIRING REQUIREMENTS:

· The hiring of the young person must be carried out after the publication of the extract of this call for grants for the year 2021.

· The hiring must represent a net increase in the workforce compared to the average workforce of workers registered in the thirty calendar days prior to the conclusion of the contract, or its maintenance when the position had become vacant as a result Voluntary leave, sudden disability, death, retirement due to age or disciplinary dismissal or for objective causes not declared inadmissible of the worker.

· In any case, there must be a correspondence between the qualification of the young person and the job held, which must be adapted to the level of studies completed and the contribution group that corresponds to this level.

EXCLUSIONS:

The following assumptions are excluded from this program:

a) Contracts that have a trial period equal to or greater than 2 months; discontinuous fixed contracts and family home service contracts.

b) Part-time contracts.

c) Workers who have terminated their employment relationship with the employing entity in the 6 months prior to hiring.

d) Hiring carried out by temporary work companies for the availability of the worker in user companies in which they will provide their services.

e) Hiring made by employers who have been excluded as beneficiaries of employment programs.

f) Hiring carried out by employers sanctioned in the two years prior to the presentation of the application for the commission of serious or very serious infractions in the field of prevention of occupational risks or Social Security.

g) Labor relations of a special nature in article 2.1 of the Workers' Statute.

h) Contracts in which the employing entity or the managerial positions or members of the administrative bodies of the companies that have the legal form of a company or private non-profit entities, maintain a relationship of spouse, ascendant, with the contracted worker, descendant or other relatives, by consanguinity

Amount of the aid / Collection procedure

The amount of the subsidy will be 23,940 euros.
If the hired person is additionally a woman or a person with functional diversity, the amount will be 25,270 euros.
If it is a person with severe functional diversity; of a young person who is under the custody or guardianship of the Generalitat or fulfilling a judicial measure derived from the criminal responsibility of minors, or who has remained in one of these two situations, in some period, during the three years prior to the age of majority; or a young woman victim of violence against women, the amount will be 26,600 euros.
The settlement of the aid will be carried out once the established conditions are justified with the documentation presented together with the application, and the amount of the aid will be released once after the concession resolution is issued.

When to request it?

Deadline for submission

The deadline for submitting applications will begin the day after the publication of the extract of this resolution in the Official Gazette of the Generalitat Valenciana and will end on June 30, 2021.
In addition to this general term, applications must be submitted within two months from the contract that is the subject of the subsidy.

What documentation must be presented?

Along with the application, the following documentation must be provided:

a) If the request is submitted non-telematically through a representative, accreditation of the representation.

b) Direct debit data, according to the standardized model. If the application is submitted non-telematically, two copies will be attached.

c) Employment contract that gives rise to the aid.

d) Responsible statement that the hiring does not cause exclusion.

e) Declaration responsible for compliance with the regulations on labor integration of people with disabilities or, where appropriate, exemption from said obligation

f) Responsible declaration on other aid received for the same eligible costs or the same eligible event or if none have been obtained, in order to verify that the limits of Article 5 (2) of Regulation (EU) 1407/2013, of the commission.

g) Responsible declaration of not being involved in the prohibitions to obtain the status of beneficiary or to be a recipient of the payment referred to in sections 2 and 3 of article 13 and section 5 of article 34 of Law 38/2003, according to the standardized model .

h) Responsible declaration of the de minimis aid granted to the applicant during the two previous fiscal years and during the current fiscal year, according to the standardized model.

i) Communication to the contracted person of the co-financing by the European Social Fund and the Youth Employment Initiative of the requested aid, according to the standardized model.

j) Report of the General Treasury of the Social Security regarding the average workforce of workers registered in the thirty calendar days prior to the conclusion of the contract (30 days).

k) Report from the General Treasury of Social Security regarding the average workforce of registered workers in the period between 30 days prior to hiring and the day of hiring the young person (31 days).

l) Documentation proving that the young person has any of the qualifications established in the fourth resolution. For these purposes, grade certificates or similar documents that do not explicitly prove said end will not be accepted. m) Responsible statement from the person hired indicating that at the time of hiring he maintains the requirements to have the status of beneficiary of the National Youth Guarantee System, authorizing the verification of said situation and stating that he understands that, in the event that it is not If these requirements are maintained, they will be excluded as the final recipient of the aid, according to the standardized model.

n) Proof of completion of the initial indicator form by the young person hired.

ñ) Certificate of the situation in the Youth Guarantee File of the young person hired.

o) Where appropriate, accreditation of the condition of a woman victim of violence against women, in accordance with the provisions of sections 1 and 2 of article 9 of Law 7/2012, of November 23, of the Generalitat, Comprehensive against the Violence against Women in the Scope of the Valencian Community.

p) Where appropriate, proof that the young person hired is under the custody or guardianship of the Generalitat, or fulfilling a judicial measure derived from the criminal responsibility of minors, or having remained in one of these two situations, at some time, during the three years prior to coming of age.

q) Where appropriate, a diagnosis of mental illness or disorder issued by the public mental health center, in accordance with the provisions of the second additional provision of Order 8/2018.

Unless the express opposition by the applicant entity or person is established (in which case they must provide the corresponding supporting documentation), LABORA Valencian Employment and Training Service will collect through the Autonomous Intermediation Platform and other systems enabled for this purpose, the relative information To the next:

a) Identity of the requesting natural person and, where appropriate, of their representative.

b) Communication to the Employment service of the employment contract that gives rise to the subsidy

c) Registration with the Social Security of the person hired

d) Positive certification from the State Tax Administration Agency, the Department of Finance and the General Treasury of Social Security, of being up-to-date in compliance with tax obligations and with Social Security.

e) Certificate or resolution accrediting the functional diversity of the young person hired, in accordance with the provisions of the second additional provision of Order 8/2018.
